T-T PUMPS
General Conditions of Sale

1. SCOPE
The following conditions are valid for all quotations and sales unless specifically otherwise agreed by individual contract. T-T in this document means:- T-T PUMPS Ltd. or its operating divisions T-T CONTROLS or AQUAFLOW. Purchasers are deemed to have accepted these Conditions prior to any purchase; the reference copy for these Conditions is the version posted on our website.

2. QUOTATIONS
Quotations are valid for 30 days from the date of issue unless otherwise stated in the individual quotation, and are subject to confirmation by T-T at the time of acceptance of order. Prices are normally quoted in Pounds Sterling exclusive of V.A.T. We reserve the right to adjust standard prices and specifications without notice.

3. ORDERS
Acceptance of orders based on quotations is confirmed by issue of a T-T order confirmation. The goods will be supplied to the confirmed price with reservation for amendment for changes in trade conditions, raw material supply, imposed taxes or similar occurrences beyond the control of T-T. Cancellation of order is permitted only after agreement between T-T and the Purchaser and against payment of charges.

4. DESPATCH/CARRIAGE TERMS
All quoted prices provide for despatch ex works T-T (i.e. Carriage extra), unless otherwise stated in our quotation.

5. DELIVERY TIMES
All delivery times are given ex our works (i.e. delivery time is when the goods leave, or are ready for despatch from, our Works), unless otherwise stated in our quotation. T-T does not accept any liability for delays in delivery which result from force majeure or any other cause outside our influence or control.

6. CLAIMS
Claims for non-receipt of goods must be in writing, and with T-T no later than seven working days after date of invoice otherwise the goods will have been deemed to be accepted by the Purchaser and the full purchase price will be payable on the due date.
Claims for goods which are delivered damaged, but for which the damage is not marked on the delivery document, must be notified to us by telephone or in writing or by e-mail not later than 3pm on the next working day following delivery of goods, followed by a written claim being submitted within 7 working days of delivery.
Claims for goods for which damage is marked on the delivery document must be notified to us in writing within 14 working days of delivery.
Otherwise the Purchaser shall be deemed to have accepted the goods as conforming to order.

7. PAYMENTS
All goods are to be paid cash prior to delivery unless a credit account has been agreed by T-T in writing. Credit payment terms are 30 days net from invoice date, unless otherwise agreed in writing by T-T. Overdue accounts will be charged with monthly interest, maximum 2% per month over our Bankers Minimum Lending Rate and a full month's interest will be charged for any part of a month. The Purchaser has no right to withhold payment due to possible claims against T-T, unless otherwise agreed by T-T in writing.

8. EXTRA COST
Should we incur cost owing to suspension or alteration of the work by the Purchaser's instructions or lack of instructions, or by reason of interruptions, delays, overtime, unusual hours, mistakes or work occasioned by the act or default of the Purchaser, such cost shall be added to the contract price and paid for by the Purchaser.

9. BAILEE
Until the purchase price is fully paid to us, the Purchaser shall remain a bailee only and the goods shall remain the property of T-T PUMPS Ltd. On default by the Purchaser, T-T shall at any time be entitled to take repossession of the goods and the Purchaser shall indemnify T-T against any loss or injury howsoever arising by his default.

10.PRODUCT SELECTION
Product performance specifications indicate the performance available from a given product and any selection of a product outside the limits of specifications should not be made. Advice on product selection can be obtained from T-T. Electrical products are normally offered for a power supply of 230V/1-Ph/50Hz, or 400V/3-Ph/50Hz, unless otherwise specified by purchaser at enquiry stage and agreed by contract.

11. SPECIFICATION
In accordance with our policy of continuing product improvement, we reserve the right to change specifications without notice; should we propose to supply an improved product specification for a previously agreed contract we will contact the purchaser and agree the revised terms before proceeding.

12. HEALTH & SAFETY
When installing equipment it is important to comply with the Health & Safety at Work etc Act 1974, and with any other relevant requirements. All electrical installations should comply with the Institution of Electrical Engineers (IEE) Wiring Regulations including amendments. Electrical products are intended for permanent hard-wired connection to the power supply, with appropriate safety devices, connections and switching. You are advised to employ the services of qualified electrical, mechanical, civil or other appropriately qualified engineers for all installations.

13.GUARANTEE
T-T gives 12 months guarantee from the date of sale on all goods manufactured or supplied by us. If within this period any defect is discovered in respect of workmanship, construction or material, we undertake to make good the defect or replace the defective part at our expense inside normal working hours at our works, or pay a sum equal to the cost of repairs at our works at our option, providing that notice is given immediately the defect is discovered and that if required by T-T the part or complete unit is returned to our works carriage paid. Spares or repaired parts are delivered ex works T-T exclusive of fitting. This guarantee does not apply to defects caused by incorrect fitting or erection, abnormal conditions of working, accident, misuse or neglect. Our responsibility is in all cases limited to the cost of making good the defect or replacing the defective part, and we can not be responsible for any consequential or other damage or losses which may occur.

14. COMPLIANCE WITH CONDITIONS
Should the Purchaser fail to comply with the agreed conditions or terms of payment T-T shall be entitled to terminate the contract and any expenses incurred by T-T will be the responsibility of the Purchaser.
